We are one of a small percentage of Qualified Intermediary service companies that belong to the Federation of Exchange Accommodators ("FEA"), a national association that is dedicated to the protection of the consumer in Section 1031 transactions and works to preserve the tax-deferred exchange options that taxpayers currently enjoy. There are less than 200 Qualified Intermediary members of the FEA nationwide, and we are proud to be one of them. We are a small, independent company that is focused solely on Section 1031 exchanges. Internal Revenue Code (IRC) 1031(a)(1) states that
"No gain or loss shall be recognized on the exchange of property held for productive use in a trade or business or for investment if such property is exchanged solely for property of like-kind which is to be held for productive use in a trade or business or for investment."

The reasoning behind this is that the investment itself does not change; only the form of the investment changes. Since the investment itself does not change and "no gain... shall be recognized," no tax is paid. This allows the taxpayer to put more money to work in the new property.
